Terms & Conditions

These terms and conditions are entered into by and between RSF Personal Training & Bootcamps LTD. (hereinafter: “Improve Glasgow”) and You (hereinafter: “the Member”).

1. Data Privacy and Protection

At Improve Glasgow, we are committed to safeguarding your privacy and protecting your personal information. We collect, use, and protect your data in accordance with our Privacy Policy and applicable data protection laws.

2. Collection of Data

We collect personal information that you voluntarily provide to us when you become a member or use our services. This may include your name, date of birth, contact details, payment information, health condition information, and other relevant data necessary for us to provide you with our services.

3. Use of Data

The data we collect is used solely for the purpose of delivering the services you have requested, administering your membership, and for communication related to those services. We do not sell or rent your personal information to any third parties. Your data will only be used in accordance with the purpose for which it was collected and in compliance with applicable privacy laws.

4. Opt-In Communication

We will only contact you in relation to the services you have opted in for. By agreeing to these Terms and Conditions, you consent to receive communications related to your membership and services. If you wish to withdraw your consent or opt-out of future communications, you may do so at any time by replying with STOP via SMS, clicking the unsubscribe link in an email, or by contacting us directly.

5. Compliance with A2P 10DLC

Our communication practices comply with the A2P 10DLC regulations. We ensure that all messaging is carried out in accordance with the guidelines and requirements set forth by these regulations.

6. Security

We implement appropriate technical, physical, electronic, and organizational measures to ensure the security of your personal data and to protect it against unauthorized access, alteration, disclosure, or destruction.

7. Services

The membership entitles the usage of Improve Glasgow facilities and the equipment & services available therein.

8. Membership

The membership is personal and cannot be shared.

9. Age Limit

The Member confirms that he/she is 18 years old or older.

For persons 16 or 17 years old, exceptions are granted based on a written parental consent. Persons under 16 years of age must be supervised at all times.

10. Health

The Member confirms that he/she does not suffer from health problems that would hinder exercise or prevent him/her from engaging in exercise, or that would be detrimental or adverse to the Member's health, safety or physical condition if he/she did exercise. In case of any doubt, the Member shall seek advice by a medical doctor who should confirm the ability to exercise.

Improve Glasgow shall have no obligation to perform a fitness assessment or similar testing to determine the Member's physical condition. If an assessment is done at Improve Glasgow, it is for the sole purpose of compiling comparative data in order to track the Member's progress in a programme and not for diagnostic purposes.

11. Liability

Each Member of Improve Glasgow shall be liable for any property damage and/or personal injury caused by the Member on the Improve Glasgow premises. It shall be the obligation of the Member to pay for any costs involved upon presentation of a statement thereof.

12. Waiver of Liability

Any and all use of the Improve Glasgow facilities shall be at Member's own risk at all times. The Member shall not utilise any equipment unless he/she knows the appropriate usage. Improve Glasgow shall not be liable for any injuries, physical impact or damages to the Member, or the property of the Member, or be subject to any claim arising out of the use of the premises and/or of the equipment made available to the users.

13. Lockers for Personal Belongings

Lockers are available for Members while working out in the facility. Each Member needs to empty the locker when leaving the facility. Improve Glasgow will open and empty lockers if the Member is not in the facility.

14. Lost Property or Theft

Improve Glasgow does not take responsibility for loss or theft of any personal belongings. Any items left on Improve Glasgow premises will be kept for a period of two weeks before being disposed of.

15. Code of Conduct

The Member shall respect the behavioural and operating principles of Improve Glasgow, as laid out in our code of conduct.

16. Suspension/Termination of Membership

If the Member behaves in a way that breaches the code of conduct, membership can be suspended or terminated at management's sole discretion.

17. Access & Security

Improve Glasgow is open Monday and Wednesday 6am-8pm, Tuesday and Thursday 6am-11am & 4pm-8pm, Friday 6am-7pm and Saturday 7am-12pm, with the exception of bank holidays and exceptional circumstances, when times may vary. Sessions are available according to times stated in the Improve Glasgow booking system. Sessions and instructors are subject to change without prior notice.

18. Payment

The Member is responsible for the payment of the membership. This is true even if the amount is debited directly by Improve Glasgow. Agreed price only applies if the Member pays according to the agreed conditions.

19. Monthly Rolling Agreement

The first month's payment (or pro-rata amount) is paid at the point of this agreement. The following monthly payments should be paid before each new month. The Member is responsible for all payments, also in the case of automatic debits by Improve Glasgow and the Member has given approval for an automatic debit from his/her account or card. Any wish to cancel must be announced with a minimum of 60 days notice, to include all payments scheduled to be made during this period.

If the payment is late the member will receive a reminder email from Improve Glasgow and access may be suspended. The membership continues to run even if the access is suspended. If after 30 days the amount is still not paid, the Member is in violation of the contract and the total outstanding amount of the contract will be due. Improve Glasgow may transfer the case to a debt collector, which will add additional fees.

20. Satisfaction Guarantee

During 7 days from the start of the membership, the Member can cancel his membership free of charge, and will be reimbursed in full.

21. Renewal & Cancellation

Annual membership (12 months pre-paid):

The contract runs for 12 months, during which time it cannot be cancelled. At the end of the contract period, the membership is automatically renewed, on a monthly rolling basis (with the option of paying up front for another 12 months) unless the Member sends a cancellation email to info@improveglasgow.com at least 60 days before the end of the contract period. Improve Glasgow will send a reminder via email 60 days before the end of the contract period. The member is responsible for his/her own cancellation, even if the email reminder was not received.

Monthly membership:

The membership extension is triggered by the payment of a subsequent month. If the Member has opted for a direct debit from an account or card, the cancellation must be announced with at least 60 days notice, with any payments due during this period to be made, by sending an email to info@improveglasgow.com.

Exceptional cancellation:

A cancellation is exceptionally granted if the Member moves more than ten miles away from Improve Glasgow's facility, on presentation of an official document to prove change of address. It is also possible to cancel the membership due to medical reasons, upon presentation of a medical certificate.

22. Price Changes

Prices will increase in line with inflation, on an annual basis, on February 1st.

23. Frozen Membership

It is not possible to freeze memberships, except due to exceptional circumstances where it is medically impossible to use Improve Glasgow's services. In this case, a signed medical certificate will be required as proof. Improve Glasgow offers extensive on-line and remote coaching and programming options so that services can be accessed whatever the location.

24. Changes to Terms

We may update our Terms and Conditions from time to time. Any changes will be posted on our website, and your continued use of our services signifies your acceptance of any such changes.
